Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Brooklyn rental property, all Healthy Homes compliance work need to be finished within 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on the Brooklyn rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, there may be an additional penalty or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or the property manager doesn’t supply the information requested within 21 days from getting the notice, the tenant could receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty of approximately $900 for property owners or property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is named on the tenancy agreement as the one who is renting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be correct at the time that the tenancy agreement is executed, and it should be maintained during the entire tenancy, as necessary work related to it’s finished.

It’s also important to keep in mind that a landlord who own several rental properties can face greater penalties for non-compliance. The highest penalties are given for serious breaches. Landlords with six or more properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

When will I need to be in compliance with requirements of the Healthy Homes Standards?

Brooklyn Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory for all Brooklyn and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with the Healthy Homes Standard that apply or will be applicable to the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

You don’t need to block holes or gaps which are part of the building. For example, tiny gaps around windows and doors may be required to allow movement of the building as the household gets warmer and cooler, in order to let them be closed and opened rather instead of being stuck. Heating Brooklyn

Brooklyn rental properties need to have a stable source of heating which can warm the living room to at least 18degC even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs to remain fixed (i.e. not portable), at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to determine if the installed heater(s) are sufficient or if you’ll need to top up by adding a second heater. If the heating that you offer is an electric heater or heat pump, then it must have a thermostat. This will help make the heating more consistent and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a central heating source, such as a heat pump, then it could require some additional energy to be able to meet the standards. Some types of heaters can’t be used to meet the standard since they’re either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Brooklyn

Insulation Brooklyn

Insulation for underfloor and ceilings is required to all rental houses from 1 July 2019. All landlords and property managers have to make sure that the insulation meets standards that are in line with the latest standard.
