Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance work need to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied lease is entered into on the Mount Victoria rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Mount Victoria and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be in force to the rental property.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
