Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Wellington Central rental property, all Healthy Homes compliance work have to be done within 90 days.

Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for the Wellington Central rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they can receive an infringement notification and be fined upto $750.

In addition, there is an additional fine of up to $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement requirements to be current when the tenancy agreement is signed, and ideally it must be updated throughout the duration of the tenancy when any associated work has been completed.

It is important to be aware that landlords with multiple rental properties could face additional fines for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own six or more properties can be fined as high as $50,000, and as much as $100,000 for hearing claims.

Wellington Central Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory to all Wellington Central and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate compliance with all Healthy Homes Standard that apply or will be applicable to their rental properties.

From July 1st 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts increase the likelihood of low temperatures inside houses. A humid house will cost more to heat, meaning wasting energy and incurring higher costs.

Heating Wellington Central

Rental properties in Wellington Central require a reliable heating source that can warm the living area to at minimum 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to be fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity and have the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to determine whether the fix heater(s) are adequate or whether you will need to top up with an additional heater. If the heating that you offer is electric heating or heat pump, it should have the thermostat. This will make the heating more reliable and effective. In most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater may suffice.

If the living area already has a central heating source such as a heat pump, then it might need an upgrade to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Wellington Central

Each living space within the rental property should include at least one open door or window to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor to take moisture away.

Ceiling and underfloor insulation is required on all rental houses as of July 1st, 2019. All landlords and property managers are required to make sure the insulation meets this new quality.
